While old clothes quickly find their way into the garment bag and dusty decorations end up in the trash without hesitation, it is not so easy to part with most contracts, even when moving. Often there is a fixed contract term and notice periods make it even more difficult to get out of a contract. However, in some contracts you have the right to special termination in some circumstances. The supply of electricity and gas is a basic right and indispensable for everyone today. Every household therefore automatically draws its energy from the basic supplier if it has never been switched to another electricity or gas provider. These contracts are open-ended and always have a notice period of two weeks. A special right of termination is therefore not necessary in this case.
The situation is different with fixed-term contracts, which usually have a term of 24 months. Many electricity and gas suppliers offer the option of a special cancellation when moving. If this is not the case, the contract can only be terminated if the new place of residence is not in the delivery area. If the move results in a higher basic price, you can generally cancel within two weeks.

Most home insurance owners will want to take advantage of this when they move into a new home. After all, it is not the apartment or house itself that is insured, but the household effects, which usually move with you. A special termination is therefore neither necessary nor possible.

However, there are two exceptions: when two people who both have home insurance move in together. If this is the case, the policy with a lower sum insured may be terminated. When moving abroad, it is also possible to make use of a special notice.

The biggest annoyance used to be the termination of Internet contracts, as these are term contracts that usually have a term of 24 months. Even in the event of a move outside of the provider's connection area, the contract could not be terminated. When moving and taking over the contract, the term was often automatically extended to 24 months.

However, since the renewal of the Telecommunications Act (TKG) in 2012, this has come to an end. The decisive factor is whether the provider can continue to fulfill the contract as before. If, as a DSL customer, one moves outside the connection area of ​​the previous provider, the contract can be terminated prematurely with three months' notice. If the contractually stipulated transfer rate cannot be maintained at the new place of residence, termination is also possible. In addition, the term is no longer automatically extended after moving.

Unfortunately, people who move in together and thus have two Internet connections in the same apartment are unlucky. There is no legal claim in this case, one can only hope for the goodwill of the provider. If both contracts are from the same provider, a mutual solution can often be found. Simply ask your service advisor for advice and support.

The Telecommunications Act also applies to cell phone contracts, even if there are seldom problems with moving. Moving abroad is the only possible reason for a special termination and even then the process can be problematic. Most mobile phone providers can offer their service abroad and see no violation of the TKG as a result. Consumer advocates, on the other hand, argue that a customer abroad often has to reckon with higher fees and thus does not receive the contractually agreed services. Often all that remains is to hope for an accommodating approach.

Due to the high demand and sometimes long waiting lists for daycare places, daycare centers are often accommodating, so that special notice is possible when the parents move. Otherwise, a special termination is contractually bound to the removal of the new place of residence and remains in effect if the child's daycare visit is still guaranteed after the move.

In the case of fitness studios or clubs, there is unfortunately no legally guaranteed special right of termination, as these contracts are usually long-term obligations. A special right of termination can, however, be specified in the terms and conditions. For an important reason, such as B. a job-related move, it is still often possible to terminate without notice. If your gym is a chain that has a branch in your new place of residence, try to negotiate a transfer on the same terms if necessary.

If use can be made of a special termination, this should in any case be made in writing by post. When sending by registered mail, you will also receive a receipt and, in case of doubt, can prove that a cancellation has been received. Before you move, find out from your provider whether you have the right to terminate the contract. Ideally, you should then cancel your contract three months in advance so that your provider has enough time to react to your cancellation and, if necessary, to set automatic payment requests. The new contract provider should also be informed of the personal termination of the old contract if they offer a cancellation service. This avoids unnecessary confusion. A move abroad usually has to be proven by a registration certificate, rental agreement or visa.
